Regulatory Status and Compliance Disclosure
This page outlines the legal nature of our service, who you contract with, and key compliance disclosures for users and regulatory bodies. Our primary goal is to provide a powerful, non-advised analytical software tool while maintaining full compliance with relevant European consumer and data protection regulations.
1. Regulatory Status: Not an Investment Firm
We are not a regulated financial firm, investment adviser, or broker-dealer.
We emphasize that Trueben does not hold a license under the European Union's Markets in Financial Instruments Directive (MiFID II) or equivalent Dutch financial regulation supervised by the AFM (Autoriteit Financiële Markten), nor any similar national financial regulation.
Our service, provided by Trueben, is strictly execution-only and informational in nature.
Core MiFID II Compliance Statement
We strictly operate under the following principles to ensure we do not fall under the definition of an "Investment Firm" or provide "Financial Advice" as defined by MiFID II:
- Non-Personalized Service: We do not provide personal recommendations that are presented as suitable for a specific client, nor are our outputs based on a consideration of any individual user's personal circumstances.
- No Suitability Assessment: We never gather or utilize information related to a user's age, income, existing portfolio, investment knowledge, or explicit risk tolerance to inform the core logic or output of the software.
- No Signals Service: Trueben does not operate a signals service and does not send you trade calls. Our software runs the indicators, alerts and automation rules that you configure, on your own platform and your own account, using generic market data (e.g. price action, technical indicators, volume). Any output is the result of your own configuration, is never personalised to your circumstances, and is acted on entirely at your own discretion. It is automated market analysis, not an investment recommendation directed at you.
- User Autonomy: All decisions to execute a trade, the size of the position, and the associated risk management settings (like stop-loss or take-profit orders) remain the sole, autonomous responsibility of the user.
- Disclaimer Required: This software is for informational and educational purposes only. It is not financial advice, and you should not construe any information or other material as legal, tax, investment, financial, or other advice. Investing involves risk, including the possible loss of principal.
2. EU Consumer Protection and Data Compliance
As we offer our digital platform to residents of the European Economic Area (EEA), we comply with key EU regulations:
A. General Data Protection Regulation (GDPR)
- Applicability: We process the personal data (name, email, payment details) of EEA residents and are therefore obligated to comply with all provisions of the GDPR, regardless of our corporate domicile.
- Data Controller: Trueben acts as the Data Controller for all client-facing operational data.
- Data Transfers: Where data is transferred to jurisdictions outside the EEA, we ensure appropriate safeguards are in place, typically through the implementation of Standard Contractual Clauses (SCCs).
B. Distance Selling and Consumer Rights
- 14-Day Cancellation Right (Reflection Period): In line with EU distance selling directives, consumers have the right to withdraw from a subscription contract within 14 days without giving any reason (subject to the terms regarding digital content usage). Use our withdrawal form to exercise this right.
- Clear Pricing and Terms: All pricing, subscription details, renewal mechanics, and cancellation procedures are presented clearly, comprehensibly, and unambiguously prior to the completion of any purchase.
3. Who You Contract With
Rubotics is a brand name. There is one legal entity behind everything on this site, and it is the entity you contract with:
| Entity Name | Primary Function | Contact / Registration |
|---|
| Trueben Sole proprietorship (eenmanszaak), Netherlands | Software developer, IP owner, platform operator and billing entity. Also provides education, consultancy and training services. Trueben is the operational identity of Ruben Treurniet and trades under the Rubotics brand. | KvK: 98842137 BTW: NL005357418B71 info@ruboticstrading.com |
Trueben is a registered Dutch business and is identifiable through the Netherlands Chamber of Commerce (KvK) register under number 98842137. For all contractual, consumer-rights, complaint, withdrawal and data-protection matters, contact us at info@ruboticstrading.com. We answer every such request through this channel, and it is the fastest route to a human. If you need our registered particulars in writing for a formal or legal purpose, ask via that address and we will provide them.
4. Market Abuse Regulation (MAR)
The Market Abuse Regulation (EU) No 596/2014 governs, among other things, "investment recommendations" (Article 20): information recommending or suggesting an investment strategy in a financial instrument, distributed to the public.
- We do not produce investment recommendations. We publish software, documentation and education. We do not tell you what to buy, sell or hold, and we do not distribute trade calls, signals or price targets.
- Educational examples are not recommendations. Where a chart, backtest or worked example names an instrument, it exists to demonstrate how a tool or method works. It is illustrative teaching material, is often historical or simulated, and is never a suggestion to trade that instrument.
- Our own positions. Ruben trades his own systems on his own accounts. Where any content discusses a system that is or was traded personally, that interest is disclosed in the content itself, so you can weigh it.
- No market manipulation. We do not engage in, and our tools are not offered for, any practice prohibited by MAR, including manipulative order patterns or the dissemination of false or misleading information.
5. EU AI Act and AI Transparency
Regulation (EU) 2024/1689 (the AI Act) introduces transparency obligations for AI systems and AI-generated content. Our position:
- AI-assisted, human-supervised. We build our software, education and site content with AI assistance under the human supervision of Ruben. Nothing here is published unreviewed.
- Labelled synthetic media (Art. 50). Images and media on this site that were generated with AI carry a visible "AI-generated, supervised by Ruben" label on the artwork itself, so the disclosure survives screenshots and re-uploads. Visuals that are hand-built simulations rather than AI output, such as our product mockups and demo animations, are labelled as illustrative or simulated instead. We label these separately on purpose: one tells you whether the media is synthetic, the other tells you whether the numbers are real.
- Our trading tools are not AI black boxes. The Expert Advisors, indicators and optimizers we sell execute deterministic, rule-based logic that you configure and can inspect. They do not make autonomous decisions on your behalf, and they are not "prohibited practices" under Article 5.
- Not a high-risk AI system. We provide trading software and education to you as the operator of your own account. We do not perform creditworthiness assessment, biometric categorisation, emotion recognition, or any other use case listed in Annex III.
6. Markets in Crypto-Assets Regulation (MiCA)
Regulation (EU) 2023/1114 (MiCA) regulates crypto-asset issuance and crypto-asset services in the EU.
- We are not a crypto-asset service provider (CASP). We do not custody, transmit, exchange, place or administer crypto-assets, we do not operate a trading platform for them, and we do not receive or transmit orders on your behalf. We hold no MiCA authorisation and require none for what we do.
- We issue no crypto-asset. We have never issued, offered or sought admission to trading of any token, coin, stablecoin (ART or EMT) or similar instrument. Any Rubotics product is software or education, paid for in ordinary currency.
- Crypto-capable tooling is still just tooling. Where our software can be configured to analyse or automate crypto instruments, it runs on your own account at a third-party venue you choose and contract with. That venue, not Trueben, provides the crypto-asset service.
- No promotion of crypto-assets. Nothing here is an offer, inducement or marketing communication for any crypto-asset. Crypto-assets are largely unregulated as investments, are highly volatile, and are not covered by investor-compensation or deposit-guarantee schemes.
